OXMETRICS End User License Agreement

License and Registration Code

The OxMetrics license is important. It represents your license from Timberlake Consultants Limited (TCL), the distributor and publisher of OxMetrics, to use the software that you have purchased. The license code will be required during the installation process.

This license is a valuable proof of purchase for your software. After using the information found here, you should store this license in a safe place for record keeping, technical support and license upgrade purposes.

Notice to user:

Please read the following carefully. By taking the positive action of entering the registration code above into your computer and thus unlocking the software, TCL will assume that you have agreed to be bound by this agreement. If you do not accept the terms of the license, you must return the package to the Seller from whom you purchased it within one calendar month and your money will be refunded.

License:

This software is protected by United Kingdom Copyright Law and international treaty provisions. The software listed above may not be installed on a network unless the license is for more than one copy (e.g. five-user license or Site License). The size of license is described under License Type.

The license type also designates the number of authorised users. A single-user license allows the software to be used on more than one computer by the same person, but no more than one copy of the software may be used at the same time. A home and office computer, for instance, would meet this requirement. A five-user license would allow up to five copies of the software to be used at the same time, and so on, a site license would allow an unlimited number of users to use the software at the same time in one site and a site license PLUS, available only to academic sites, allows the site administrator to make copies of the software media to distribute to students. A global site license allows an unlimited number of users to use the software at the same time at multiple sites. Only five-user licenses and above can be installed on networks.

TCL authorises the purchaser to make archival copies of the software for the sole purpose of backing-up the software in order to protect the purchaser’s investment from loss.

Copyright and Limited Warranty

The Software is owned by the Author(s), as listed on http://www.oxmetrics.net, and is protected by United Kingdom and other copyright laws.

You must treat the Software like any other copyrighted material.

The only warranty TCL makes is that the media on which the software is recorded will be replaced without charge if TCL determines that the media was defective and not subject to misuse, and if returned to TCL or the dealer from whom the software was purchased within 30 days of purchase.

TCL makes no other warranties, either expressed or implied, and TCL shall not be liable for warranties of fitness of purpose or merchantability, nor for the special, incidental, or consequential damages such as loss of profits or inability to use the software.

With respect to the installation media and the programs contained within the installation media, TCL shall have no liability with respect to any loss or damage directly or indirectly arising from the use of the disk or any program reproduced on the disk. Without limiting the foregoing TCL shall not be liable for any loss of profit, interruption of business, damage of equipment or data, interruption of operations or any other commercial damage, including but not limited to, direct, indirect, special, incidental, consequential or other damages. The remedy for breach of this warranty shall be limited to replacement of the media and shall not encompass any other damages.

Sole Agreement and Governing Law.

This is the only agreement between the purchaser and TCL and it cannot be modified unless a written amendment has been signed by one of our company officers. This license shall be construed, interpreted and governed by English law.
